These Terms and Conditions (“Terms”) govern your access to and use of the products, services, and software offered by RankFuse (“Company,” “we,” “us,” or “our”) through rankfuse.com (the “Site”). By accessing the Site, creating an account, or purchasing any product or service, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. Services
RankFuse provides software-as-a-service (SaaS) products, digital marketing tools, and related services, including but not limited to X-Ray Leads and any other products listed on the Site. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.
2. Eligibility
You must be at least 18 years of age and have the legal authority to enter into a binding contract to use our services. By using the Site, you represent and warrant that you meet these requirements.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.
4. Subscriptions and Billing
4.1 Subscription Plans
Our SaaS products are offered on a subscription basis with monthly and annual billing options. Plan details, features, and pricing are described on the applicable product or pricing page at the time of purchase.
4.2 Setup Fees
Certain plans require a one-time, non-refundable setup fee that is charged at the time of signup, prior to the start of any trial period or recurring subscription. The setup fee covers onboarding, configuration, and account activation.
4.3 Free Trials
Where offered, free trial periods begin after the setup fee is collected. At the end of the trial period, your subscription will automatically convert to a paid plan and your payment method on file will be charged the applicable recurring rate unless you cancel before the trial ends.
4.4 Recurring Charges
By subscribing, you authorize RankFuse to charge your payment method on a recurring basis (monthly or annually, depending on your selected plan) until you cancel. Subscription charges are processed through Stripe. You agree to Stripe’s terms of service in addition to these Terms.
4.5 Price Changes
We reserve the right to change subscription pricing at any time. We will provide at least 30 days’ notice before any price change takes effect for existing subscribers. Continued use of the service after a price change constitutes your acceptance of the new pricing.
4.6 Taxes
Prices displayed do not include applicable taxes. You are responsible for all taxes, levies, or duties imposed by taxing authorities related to your purchase.
5. Refund Policy
All sales are final. We do not offer refunds under any circumstances, including but not limited to setup fees, subscription payments, annual plan payments, or partial-period charges. This applies regardless of usage, satisfaction, or cancellation timing. By completing a purchase, you acknowledge and agree to this no-refund policy.
If you believe a charge was made in error, contact us at support@rankfuse.com within 7 days of the charge and we will review the matter at our sole discretion.
6. Cancellation
6.1 How to Cancel
You may cancel your subscription at any time through your account dashboard or by contacting support@rankfuse.com. Cancellations must be received before your next billing date to avoid being charged for the following period.
6.2 Access After Cancellation
Upon cancellation, your access to the service will continue through the end of your current paid billing period. After that date, your account will be deactivated and access to the service will be terminated. We are not responsible for any data loss following account deactivation.
6.3 Annual Plans
If you cancel an annual plan, you will retain access through the end of the annual period for which you have paid. No prorated refunds will be issued for unused months.
7. Acceptable Use
You agree not to use our services to:
- Violate any applicable law or regulation
- Infringe upon the intellectual property rights of any third party
- Transmit spam, malware, or other harmful content
- Attempt to gain unauthorized access to our systems or any third-party systems
- Resell or sublicense our services without written authorization
- Engage in any activity that disrupts or interferes with the integrity or performance of the services
We reserve the right to suspend or terminate your account without notice if you violate this section.
8. Intellectual Property
All content, software, trademarks, logos, and materials on the Site are the exclusive property of RankFuse or its licensors. Nothing in these Terms grants you any right to use our intellectual property without prior written consent. You retain ownership of any data you upload to the platform, and you grant us a limited license to use that data solely to provide the services.
9. Data and Privacy
Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.
10. Third-Party Services
Our services integrate with third-party platforms including Stripe, GoHighLevel, and others. We are not responsible for the availability, accuracy, or conduct of any third-party services. Your use of third-party services is governed by their respective terms and policies.
11. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
We make no guarantees regarding specific results, lead generation volumes, revenue outcomes, or marketing performance from use of our products.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RANKFUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO RANKFUSE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify and hold harmless RankFuse and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the services, your violation of these Terms, or your violation of any third-party rights.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Kansas. You waive any objection to venue or jurisdiction in such courts.
15. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site with a new effective date. Your continued use of the services after the effective date constitutes acceptance of the revised Terms.
